Adem Terms of Use

Closed challenge test

The optional online feature offers 15, 30 or 90 days, a €25–€100 test deposit and a €4.95 test fee. No real money is collected or donated to KWF. After relapse, choose a deposit refund, KWF or a restart with another test fee. The test flow offers full cancellation of that challenge payment within 14 days of starting. This test policy is not a final legal assessment for real payments. The local features below remain available without an account.

1. Provider and scope

Adem is provided by Micor de Grood, contact support@getadem.nl, correspondence address [nog te bevestigen / to be confirmed]. These terms apply to this consumer app. Statutory consumer rights always remain in force. Current web terms: https://getadem.nl/voorwaarden.

2. Purpose and pricing

Adem helps you keep a personal quit plan, moments and experiences. This version requires no Adem account and contains no purchase or subscription feature. If paid features are introduced later, price, duration, payment, renewal, cancellation and applicable consumer rights will be explained separately in advance.

3. Not medical treatment or a results guarantee

Adem provides general support and estimates, not a diagnosis, personal treatment plan or substitute for a doctor or stop-smoking adviser. It does not guarantee that you will quit or achieve a particular health outcome. Estimated savings are calculated from your entries, not measured health improvements.

Use exercises only if comfortable and stop if you feel discomfort. Seek professional advice for health questions, medication or quit-smoking aids. Adem is not an emergency or urgent-care service.

4. Use and content

You receive a personal, non-exclusive right to use the app under these terms and applicable Apple terms. You retain rights to your own notes and entries; using the app does not authorize publishing them as advertising. Misuse, infringement and unauthorized access are prohibited. Statutory rights, such as permitted interoperability, are not excluded.

5. Storage and recovery

Your plan is stored locally. You can make copies and optionally save automatically to a folder of your choice. Keep an off-device copy to protect against phone loss. File services and connectivity affect upload completion. Automatic saving is not guaranteed continuous synchronization or automatic merging across devices.

Restoring requires confirmation and replaces current data. Check the file you select. Copies use storage and remain until you remove them. This advice about keeping copies does not limit our legal obligations or your consumer rights.

6. Availability, updates and changes

We aim to provide a carefully functioning app but cannot promise uninterrupted or error-free operation. Report problems to support@getadem.nl. We assess reported faults and provide remedies as reasonably and legally required. Statutory obligations concerning conformity, security and necessary updates remain applicable.

For major changes or discontinuation, we will provide timely notice where reasonably possible and legally required, and an opportunity to export data. Continued use alone does not automatically make every change legally binding; applicable legal rules and required agreement still apply.

7. Liability

Liability is determined under applicable law. These terms do not exclude liability that cannot legally be excluded, including applicable rights relating to personal injury, intentional misconduct, gross recklessness and mandatory consumer protection. There is no blanket clause making all use solely your own risk. Relevant factors include the circumstances, responsibility and connection to the claimed loss.

8. Privacy and third parties

The privacy notice explains local processing, optional analytics and backups. Apple, your file service and external websites have their own terms. Linking to a site is not a guarantee of its content or a claim of partnership.

9. Apple and complaints

The applicable Apple Standard Licensed Application End User License Agreement governs the App Store licence: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ . These terms do not replace mandatory Apple provisions or statutory rights. The Adem provider, not Apple, is responsible for the app to the extent required by law and applicable Apple terms.

Contact support@getadem.nl with complaints. Dutch law applies insofar as it does not deprive you of mandatory protections in your usual country of residence. You retain access to the courts competent under applicable law.
